Indiana Marijuana Legalization: Will 2025 Be the Year?


Indiana stands as one of the few remaining states with a total ban on marijuana. Despite growing support for legalization, the state has been slow to act. With changes at the federal level and increasing pressure from advocates, 2025 might finally be the year Indiana joins the growing list of states that have embraced marijuana legalization.


The Current Legal Landscape

Indiana is one of just 12 states where marijuana is entirely illegal. Possession, sale, and use of marijuana are prohibited, with strict penalties in place for violations. The state does allow the possession of "low-THC hemp extract," meaning CBD oil containing less than 0.3% THC, but this is a far cry from the comprehensive medical marijuana programs seen in neighboring states.


In May 2024, the U.S. Department of Justice recommended reclassifying marijuana from a Schedule I controlled substance, which is reserved for drugs with no accepted medical use and a high potential for abuse, to a Schedule III substance. 


This change acknowledges the medical benefits of marijuana and significantly reduces its legal stigma. While marijuana remains federally illegal, this reclassification has reignited the push for legalization in Indiana.


Advocacy and Legislative Efforts

Advocates like Keith Johnson, a U.S. Navy veteran from Indianapolis, have been at the forefront of the battle for legalization. After suffering a traumatic brain injury in a car accident, Johnson found relief in marijuana, which helped him manage pain and regain his quality of life. His story is not unique, and many veterans and patients with chronic conditions share similar experiences.


Johnson regularly testifies in favor of changing Indiana’s strict marijuana laws. “We’re creating interstate drug traffickers out of our vets, who have to go to Illinois and Michigan to get relief,” Johnson said. “If we care about that community, we need to change that.”


Support for legalization is widespread among Indiana residents. According to the Bowen Center for Public Affairs at Ball State University’s annual Hoosier Survey, only 10% of respondents believe marijuana should remain illegal. Despite this overwhelming support, legislative progress has been slow.


Legislative Roadblocks

The Indiana General Assembly has seen numerous marijuana-related bills over the years, but none have advanced to a committee hearing. In the 2024 session alone, at least 10 bills were proposed, including measures to legalize medical marijuana and decriminalize possession of small amounts. Unfortunately, these efforts have consistently been blocked by the Republican leadership.


State Rep. Sue Errington, a Muncie Democrat, has been a relentless advocate for medical marijuana legalization. She believes the reclassification at the federal level should prompt Indiana to reconsider its stance. “By definition, given the fact that it’s not a Schedule I anymore, it’s an admission that there are medicinal purposes for it,” Errington said.


Errington and her colleagues argue that legalizing medical marijuana is a logical first step. It would provide much-needed relief to patients with conditions such as seizures, chronic pain, and terminal illnesses. Additionally, legalizing medical marijuana could help address racial disparities in drug-related arrests and generate significant tax revenue for the state.

U.S. Sen. Mike Braun, the Republican gubernatorial nominee, has expressed openness to the idea of medical marijuana, while Democratic nominee Jennifer McCormick has included legalization in her campaign platform. These shifts in political attitudes are encouraging signs for advocates.


Despite the optimism, significant challenges remain. State Sen. Scott Baldwin and other opponents of legalization continue to express concerns about public safety, youth access, and potential increases in Medicaid expenditures. These concerns will need to be addressed through careful policymaking and robust regulatory frameworks.


Indiana’s journey toward marijuana legalization has been slow, but recent developments suggest that change could be on the horizon. With strong public support, advocacy from veterans and patients, and a favorable shift in federal policy, 2025 might be the year Indiana finally embraces medical marijuana.
